1. Introduction

1.1. These Terms and Conditions (“Agreement”) govern your access and use of the “It’s a Match” mobile application (“the App”) provided by Tattva Design Lab India Private Limited (“the Company”).

1.2. By accessing or using the App, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you must not use the App.

2. User Registration and Account

2.1. In order to use the App, you must register an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and are liable for any activities conducted through your account. You must promptly notify us of any unauthorized use or security breach of your account.

3. App Usage and Services

3.1. The App provides a platform for individuals and organizations to connect with potential blood donors. Users can create and respond to blood donation requests, schedule appointments, and communicate with each other through the provided features.

3.2. The Company acts as a facilitator in the connection process and does not conduct blood transfusions or verify the accuracy of user-generated content. You understand and acknowledge that we are not a blood transfusion business, laboratory, or medical facility. We do not test blood or conduct medical procedures. The process of blood collection, testing, and transfusion is the sole responsibility of authorized medical facilities, such as hospitals and blood banks.

3.3. The It’s a Match platform solely serves as a connection tool between blood donors and recipients. It is important to note that the responsibility of processing, testing, and conducting the actual blood transfusion lies entirely with the participating hospitals and blood banks. It’s a Match does not assume any liability or responsibility for the actual transfusion process or any consequences arising from it. Users are advised to rely on the expertise and protocols of the respective hospitals and blood banks for safe and appropriate blood transfusion procedures.

3.3. Users of the App must use it responsibly and comply with all applicable laws and regulations. Users are solely responsible for their interactions and transactions with other users of the App.

4. User Obligations

4.1. By using the App, you agree to the following obligations:

• Provide accurate and up-to-date information about yourself and the blood donation requests you create.
• Comply with all applicable laws, regulations, and guidelines related to blood donation and health and safety standards.
• Treat all users with respect and refrain from engaging in any discriminatory, offensive, or harmful behaviour.
• Use the App solely for its intended purpose and refrain from using it for any illegal or unauthorized activities.

5. User-generated Content

5.1. Users of the App may post, upload, or submit content, including text, images, videos, and other materials (“User Content”). By posting User Content on the App, users represent and warrant that they have the necessary rights to the User Content and grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, distribute, and display the User Content for the purposes of operating and promoting the App.

5.2. Users must not post any illegal, offensive, defamatory, or infringing content on the App. The Company reserves the right to remove any User Content that violates this Agreement or is otherwise objectionable, without prior notice.

6. Privacy and Data Protection

6.1. The Company collects and processes personal information in accordance with its Privacy Policy. By using the App, you consent to the collection, use, and disclosure of your personal information as outlined in the Privacy Policy.

6.2. The Company takes reasonable measures to protect the security and confidentiality of user information. However, no data transmission or storage system can be guaranteed to be 100% secure. Users are responsible for maintaining the security of their own accounts and should not share their login credentials with others.

7. Intellectual Property Rights

7.1. The App and its content, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are owned by the Company and protected by intellectual property laws. Users must not copy, modify, distribute, or reproduce the App’s content without prior written permission from the Company.

8. Termination and Suspension

8.1. The Company reserves the right to suspend or terminate a user’s access to the App if they violate this Agreement or engage in any conduct that the Company deems harmful or disruptive. Termination may result in the loss of data associated with the user’s account, and the Company shall not be liable for any such loss.

8.2. Users may also terminate their account at any time by following the instructions provided in the App.

9. Limitation of Liability

9.1. The App is provided on an “as is” and “as available” basis. The Company does not warrant or guarantee the accuracy, completeness, or reliability of the App or its content. Users acknowledge and agree that their use of the App is at their own risk.

9.2. To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of the App.

10. Modifications and Termination

10.1. We reserve the right to modify, suspend, or terminate the App or your access to it, in whole or in part, at any time and for any reason without prior notice or liability.

11. Governing Law and Jurisdiction

11.1. This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction of Vijayawada, Andhra Pradesh, India. Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Vijayawada, Andhra Pradesh, India.

12. Modifications to the Agreement

12.1. The Company reserves the right to modify or update this Agreement at any time, without prior notice. Users are responsible for regularly reviewing the Agreement for any changes. Continued use of the App after any modifications to the Agreement constitutes acceptance of the modified terms.
